GENERAL TERMS AND CONDITIONS OF TRAVEL CONTRACTING

  1. Applicable Legal Framework

These General Terms and Conditions are subject to the provisions of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws. 

They apply to the contracting of package travel through the travel agency’s website and comply with the provisions of Directive (EU) 2015/2302 of the European Parliament and of the Council, relating to package travel and linked travel arrangements, as well as with the current Spanish regulations regarding tourism and consumer protection.

  1. Purpose of the Contract

These conditions regulate the contractual relationship between the travel agency and the customer who purchases tourism services through the website. The booking of a trip implies express acceptance of all the conditions described herein.

  1. Definition of Package Travel

A package travel is defined as the combination of at least two different travel services (for example, transport, accommodation or other significant tourist services) purchased for the same trip or holiday, in accordance with Directive (EU) 2015/2302.

  1. Joint Liability of Organizer and Retailer

When both a package travel organizer and a retail travel agency are involved in the contract, both parties shall be jointly liable to the traveller for the proper performance of the services included in the contract. The traveller may submit claims either to the organizer or to the retailer who managed the booking of the trip.

  1. Reservation and Confirmation Process

Travel reservations must be made through the booking forms available on the agency’s website. The reservation will be confirmed once the availability of the services has been verified and the corresponding payment has been received. The client will receive confirmation by email including all the details of the contracted trip.

  1. Price of the Trip

The price of the trip will be the one indicated at the time of booking and will include only the services expressly specified in the travel programme or quotation. Unless otherwise stated, the price does not include:

  • Local tourist taxes
  • Visas
  • Optional insurance
  • Excursions not included in the programme
  • Personal expenses or additional services
  1. Payment Terms

To confirm the reservation, an initial deposit may be required. The remaining balance must be paid before the date indicated by the agency. Failure to comply with the payment deadlines may result in the automatic cancellation of the reservation.

  1. Air / Maritime Transport Conditions

Flights or ferry journeys included in the trip are subject to the general conditions of the respective airlines or shipping companies. Flight schedules are indicative and may be modified for operational reasons.

Rules relating to:

  • permitted baggage
  • check-in procedures
  • required documentation
  • transport of special baggage

will be governed by the conditions of the airline or shipping company.

  1. Liability for Baggage

Liability for loss, damage or delay of baggage rests with the airline or the responsible carrier, in accordance with the applicable international conventions (such as the Montreal Convention). In the event of an incident, the traveller must submit the relevant claim directly to the transport company.

  1. Overbooking or Denied Boarding

In the event of overbooking, flight cancellation or denied boarding, the airline will be responsible for applying the compensations provided for in European legislation (Regulation EC 261/2004).  The agency will assist the traveller in managing the incident whenever possible.

  1. Accommodation Conditions

Hotel establishments will be governed by their internal regulations regarding:

  • check-in times
  • check-out times
  • room allocation

Special requests made by the client will be subject to the availability of the establishment.

  1. Travel Insurance

Unless expressly stated otherwise, the trip price does not include assistance or cancellation insurance. The agency may offer optional insurance policies covering incidents such as:

  • trip cancellation
  • medical assistance
  • baggage loss
  • trip interruption
  1. Assistance to Travellers at Destination

In accordance with the regulations applicable to package travel, the organizer and/or the agency will provide appropriate assistance to travellers in difficulty during the trip, particularly in cases of: 

  • lack of information regarding health services or local authorities
  • assistance with remote communications
  • help in finding alternative solutions in case of serious incidents
  1. Trip Modifications

The agency may modify certain aspects of the trip for justified reasons.

In the event of significant modifications, the traveller will be informed as soon as possible and may accept the proposed changes or terminate the contract without penalty.

  1. Cancellations by the Traveller

Each trip is quoted with specific cancellation terms; however, the traveler may cancel the trip at any time prior to its start by providing written notice to the agency.

In such cases, the following cancellation fees may apply:

  • More than 60 days before departure: administrative fees
  • Between 60 and 30 days: 25% of the trip price
  • Between 30 and 15 days: 75% of the trip price
  • Between 15 days and the arrival date: 100% of the trip price

Penalties may vary depending on the conditions imposed by service providers (airlines, hotels, etc.).

  1. Name Changes on Tickets

Name changes on transport tickets, particularly flight tickets, will be subject to the conditions of the respective airline.

In many cases, tickets are personal and non-transferable, and name changes may involve:

  • administrative charges
  • fare recalculation
  • the issue of a new ticket
  1. Group Travel

Trips involving 10 or more participants under the same reservation will be considered group travel.

Specific conditions may apply to these trips, such as:

  • special confirmation deposits
  • different payment deadlines
  • specific cancellation conditions

complimentary places or discounts for group coordinators

Individual cancellations within a group may affect the final price for the remaining participants.

  1. Force Majeure and Extraordinary Circumstances

The agency shall not be held responsible for the non-performance or modification of services when unavoidable and extraordinary circumstances occur, such as:

  • natural disasters
  • armed conflicts
  • epidemics or pandemics
  • strikes in the transport sector
  • governmental decisions

In such cases, the client will be informed as soon as possible, and reasonable alternatives will be offered whenever possible.

  1. Data Protection

The personal data provided by the client will be processed in accordance with the General Data Protection Regulation (GDPR) and the current Spanish legislation.

  1. Applicable Law and Jurisdiction

These conditions shall be governed by Spanish legislation regarding tourism, consumer protection and package travel, as well as by Directive (EU) 2015/2302.

For the resolution of any dispute, the parties shall submit to the competent courts in accordance with the applicable legislation.
